German work permit based on marriage to EU citizen

Post by andrew007 » Mon Apr 26, 2010 8:53 pm

Hello everyone,

I am trying to find out what do I have to do to get a working permit in Germany. I am married to an Italian, I am from Uruguay, and I am currently living in Netherlands, with a residence permit based on my wife's citizenship. I tried looking around to see how to apply but have not found yet the specific steps that I have to do to get the permit.

Basically I do have a job offer from a German company, so I will have an income while there.

I am also planning to start working basically as a consultant for the company and billing hours while I am still residing in Netherlands, anyone has any experience on the matter? I do have the steps I need to follow to get my unipersonal company in Netherlands, but I am not sure if I have to get the company registered in Germany too or if this is feasible at all.

Thanks in advance for any light you can shed in this matter.

KR,
Andres.

Ta!

I seem to remember setting up a German company is expensive and difficult, try ToyTown Germany for that. Think you would be better as a Freiberufler, ie self-employed, as a cross-border worker. Google "cross-border worker AND EEA" and see what comes up - there are special rules, it's a topic I don't know much about I'm afraid!

You have a full right to work in whatever EU country your wife is working in.

Being employed by a German firm may be more difficult while you and your wife reside in the Netherlands.

Couple of ideas if you can not do it directly:

(1) Move to Germany with your wife. Live close enough to the Dutch border that she can commute to her job in the Netherlands. (This may or may not help, depending on whether Germany will give you a residence permit while your wife continues to work in the Netherlands).

(2) Work for a Dutch firm, through which you are paid, and have them have a contract with the German firm.
