Getting married - Switching from BN(O) visa to Spouse visa

Post by MadMaxx24 » Fri May 03, 2024 8:54 pm

Hello everyone,

I am currently on a BN(O) visa which allows me to live and work in the UK for 5 years. I can apply for the Indefinite leave to remain in April 2026. My partner and I are looking to get married this year. I have a few questions regarding this:

1. Do I need to switch from BN(O) visa to Spouse visa?

2. If yes, do they calculate the 5-year continuous period from when I start the Spouse visa or does my BN(O) visa count towards the 5 years?

Any help would be much appreciated!

Thanks in advance :)

No - there's no obligation to switch. You can stay on BN(O) visa.

Thanks so much for your reply :)

Another QQ - Regarding the notice of marriage, do I need to give 29 days or 70 days notice? My partner and I both have a British passport. I am a British National (Overseas) and he is a British Citizen. Not sure if I need to give 70 days extended notice?

Any help would be much appreciated. Thank you
