Giving birth abroad ( Europe)

Post by Layan13 » Sat Jul 12, 2014 10:04 am

Hello,

I am British Citizen just became a doctor and working in Germany, My wife is a Yemen Citizen but has the
German Family Permit ( 5 Years ).
I am British by decent as I was born in Yemen and got citizenship from my mum but I have lived over 20 Years in the UK.
If my wife gets pregnant and gives birth in Germany can the baby get British Citizenship and if so what is needed.

Many thanks

Has the Mother and Father been in the UK for 3 years? If so, how many days absence in the last 3 years?

Then it appears there would be an entitlement to registration under section 3(2) which would give citizenship by descent once registered. The alternative would be registration under s 3(5) which would give citizenship otherwise than by descent but would require both parents to have been in the UK 3 years before the application but for allotted absences.
