Got Approval, Dependent also eligible - to apply or not?

Post by ChandraSP » Fri Jul 02, 2004 3:42 pm

Hi Friends,

I got the approval and thanks once again to all the members on this board.

My spouse also has eligibility to apply for HSMP (scored 65 points exactly). Some of the members mentioned that, it doesn't make any difference having a HSMP or Dependent HSMP visa. So, she didn't applied separately.

Before going for EC, I just started checking some of the opportunities available and got a very favorable response from one of the employer which may need travel across Europe as part of pre-sales tech support engineer.

So, in this situation, is it better if she apply separately for HSMP. If we both have individual work permits, can they be used to safeguard each other. Any advantages both having different HSMP visas?

Pl let me know the members comments.

Of course I still remember Kaya's comments. :D

"The HSMP requires a signed undertaking (do you remember that part of the form?) that you will make the UK your main home. The UK Home Office at the time of HSMP renewal take into consideration absences form the UK for employment reasons on behalf of your UK employer and/or UK based self employment e.g conferences, training workshops etc. Lengthy absences from the UK as you describe where you are working abroad for a foreign based company will result in your HSMP extension application failing due to a lack of 'economic activity' in the UK - it is your economic activity as the principle applicant that is considered not your spouse's. No HSMP renewal for you = No HSMP dependent renewal for your wife = you must both leave the UK. Nice try but the HSMP Team knew this would be a loophole and they shut it pretty tight ."

Thanks in advance.

Regards
Puti

If she is already approved, I would certainly suggest going to the length of keeping your HSMP status independent of each other - this way your double your chances for renewal (and subsequently, for ILR) should one of you become unemployed.

puti,

Will echo Cosmopol's post - get both of you on HSMP- double insurance policy. You can then get away with not being in the UK for ILR purposes as per your initial query (am getting on in age but my memory is not too bad  ) but not naturalisation purposes..you need to spend 3 or 5 years in the UK as the case may be at some point in time for the latter 8) .
