Hi

I've got hsmp VISA and just got an extension; under tier1. So I've got tier 1 visa till 2012.

I've been working in UK for 2 yrs now but due to some personal reasons i need to go back for a year or may be more to my country. I know my settlement counter of 5 yrs would be reset and i accept that. After a year or more i'll be coming back and resuming my work. BUT people have told me immigration wont let me in if I stay more than 3 months outside UK for non work reasons.

Any guidance would help.

I think that's rubbish unless someone can point to a hidden chapter in the Border Force manual.......

No I agree. :). No problem at all, as long as you do relise that your ILR ticker is reset.

On a similar note, assuming I were to get a 3-year initial EC under Tier 1 (transitional arrangements), but decided to move to the UK about a year into the EC validity, I would have only stayed in the UK under Tier 1 for 2 years out of the initial 3-year visa.... Would my FLR then be for a further 2 years (and then extend again for another year or two) or could I get FLR for 3 years?

So then I'd have to do 3+2+1 or 3+2+2 to meet the ILR requirement... i.e. go through 2 FLRs???

u need to apply for another flr and go thru point scoring and all the process involed in it..as per current rules..if rules change thats a separate issue
