I got HSMP's Refused can i apply PSW in Appeal Time?

Dear Friends,

I applied HSMP in April 2008 and my student visa was running out in May 2008, since April 2008 unit 20 August 2009 they had my passport and they gave me refusal on 21 august 2009 and i have got appeal right until 9 September 2009, during this time i have done my Master degree and i have got bank maintenance as well so can i apply for PSW in HSMP's appeal time or not ? actually i heard that if you apply PSW you should have Valid student visa , but in my case my passport was in home office ,
so any buddy have got any idea what should i do ?

sorry u cant make new application, appeal is the only available option 4 u as u did not have current valid leave

1. No as u do not have a valid leave to apply
2. U only chnace is to go bak home and apply from there if its an initial application.
3. Other option is to go with u appeal if u think u cna win it and if u can not then do not waste time her and go bak home and apply from there.

I spoke with my solicitor he is also saying that i can not apply PSW and i have got only appeal's option , and if i can not win appeal so may be i will go to hight court , but i am running my back home account for PSW ,

1. If u already have a bank account then it shud be easy for u to apply from bak home.

I have submitted my appeal, lets see what gonna happen , pray for me ,
but i am a little bit unlucky , i have got MSc Degree , bank maintenance ,
University Latter but i can not apply for PSW because i do not have valid visa
