GTV to ilr, and dependents' extension?

Post by astronomin » Sat Jul 13, 2024 1:15 pm

Thank you so much for your help!

My current VISA status is newly updated GTV (07. 2024 to 07. 2026). And I plan to apply for ILR in June 2025, one month before completing 3 years on my GTV. I have questions about my dependents:

1. In that time, my wife will have been a GTV dependent for 3 years as well, but with 1 year remaining on her visa (expiring July 2026). We should apply for her extension (only 3 years) when I apply for ilr? Only 3 years are possible, right? Also, this means is there any refund for the remaining 1 year of her ihs fee?

2. I should also apply for 3 years for my son's GTV? If I need to extend my son's GTV, I must "waste" 3 years of GTV-dependent (fee+ihs; which are a lot) money? I meant I've learnt that when my ilr has been approved, we can also apply for my son who was born in the UK with British citizenship (as per https://www.gov.uk/apply-citizenship-born-uk/under-18). Regarding my son's British citizenship, when would I be eligible to apply?

Thank you. so much for your consideration! Have a great weekend!

Sorry one more question.

3. They said I am not required to extend my dependents' visas at the exact same time I apply for your ILR as their visas remain valid until their expiration date, regardless of your ILR application? Is it true?

1. The extension visa period is fixed. You can't get a shorter period and no refunds will be given if she later gets ILR. IHS payment will based of the duration of visa granted

2. Your UK-born son does not even need a visa or ILR to be registered as British. After you get ILR, he can be registered as Biritsh using form MN1

3. Yes. Their visas remain valid until expiry. Your ILR has no effect on that
