H1B Transfer

H1B Transfer

I got laid off in December 2004 and immediately started working in another company after H1B transfer was filed.

Initially, we had filed a normal H1B processing. After not receiving the transferred I797 for 7 months, we filed Premium H1B transfer. I have now crossed the 15 business days deadline promise for Premium processing.

In summary, it has been more than 8 months since we first filed for my H1B transfer. I believe I am still legal to keep orking.

My questions are:
1. How long am I going to be legal like this?
2. What if I receive a rejection in h1B transfer? Can I appeal? I am assuming I will have to stop working immediately? Do I have to leave the country after the appeal is made?

My wife is also working on H1B visa. If needed, I can go on H4 dependent visa immediately. How long do I have before I can do this paperwork of change of status? What is the procedure?
