I have recently read some updated news about the HSMP judicial review from the Home office website,

On the HSMP review 09 policy, paragraph 9 it says …Migrants will be allowed to apply for a one-off payment to cover the cost of second extension application which would not otherwise have been required…..
And it also says…..In addition, if you apply for citizenship in the future, you will be considered to have been settled in the United Kingdom from the point when you first completed four years qualifying residence. When we send you your one-off payment, we will also send you a letter to confirm this. If you apply for citizenship, you will need to send the letter with your application as confirmation of your position.
Here is my husband basic information;
--18th Nov 2003 Work permit granted letter
--23rd Feb 2006 HSMP Granted letter (However, LTR on passport was granted for 2 years on 28th April 2006)
--30th April 2008 Tier 1 Granted letter
--12th Feb 2009 Settlement granted (having completed five years continuous residence in a qualifying category)
and I would be grateful if you could help me with 2 questions.
1. Can my husband apply for one-off payment to cover the cost of Tier 1 extension which would otherwise not been required if he could apply ILR in Nov 2007?
This is a bit tricky one as my husband got 2 years HSMP on his passport initially though he received HSMP approval letter before 3 April 2006.
To some extent, the tier 1 extension may not be counted as second extension
2.If we can not apply for one-off payment, where can we get a confirmation letter form the home office in order to apply Citizenship?
