if i have student tier 4 dependent visa and apply for tier1

general based on indian 12 months earnings and apply for tier1 general in march 2011. will intrim limit applicable to me.please help me

You may apply if you qualify with earnings in 12 months (of the 15 months window) preceding the application. Since you can switch (apply from within the UK), the interim limit / cap does not apply to you.

Yes I qualify for Indian 12 months earnings. I will be getting my tier4 student dependent visa by January 25th 2011. Planning to travel to UK by February 2011 25th. shall I come to back to India and apply for tier1 general. Appreciate your quick reply.

even if i apply from with in the UK , I will be showing India 12 months earnings. Is it ok.

Yes. Reading the policy guidance should help you understand what documentary evidence(s) you require for a Rier 1 (General) application.

The post you are referring to is from Tier 4 to Tier 1 PSW. You want to go to Tier 1 General. See the link provided by sushdmeta.

Bottom line: You are allowed to switch from Tier 4 dependent to Tier 1 General.

here are my earnings details


Earnings period : From Feb 2010 to January 2011

From IBM and Rofous (full time )during this period earnings during this period is 5.8 lacks
From r UK consultency (part time ) during period August 2010 to January 2011 is 2000 GBP

By January 2011 I will be getting student dependent visa

In Feb 2011 I am planning to travel to UK

in March 2011 I am planning to apply for tier1 general based on above earnings period from UK.

Could you please help me am I eligible or not in this scenario. I think cap limit is not applicable to me as I am planning to from UK .
