Help : Can my tier 2 visa help me to transit in London?

Post by Scorpio76 » Mon Dec 16, 2013 10:58 pm

I hold a Passport for an Arabic Country that requires UK transit visa. Also, I hold a Tier 2 (Partner) visa which is valid until end of 2014. I used it to travel to Canada via London. However, my husband has changed his employer in UK and he had to change his Tier 2 visa to the new employer. I am still in Canada but my permanent resident card is expired. When I applied for the new Tier 2 visa (under the new employer) from Canada, worldbridge told me that my Permanent Resident Card had to be valid. Now, I need to go back to my country as per my return ticket but I can't even get a transit visa to UK. What can I do? Shall I travel via UK with my old Tier-2 visa which shows that it is still valid?

For what purpose do you wish to enter the UK? That is the standard question (or words to that effect) that greets arriving passengers. If you are travelling to see your partner you have the correct visa. If you are not there to see him but are merely transiting, you don't have the correct visa. Entry is granted on the suitability of the visa for the intended purpose.

I am not quite sure why you were applying for a new 'tier 2 visa' do you mean a new 'tier 2 dependent visa' in which case there is no need for you to apply for a new visa if your partner is changing employer, only your partner needs to change his visa. What are your plans after you return home, will you be travelling back to the UK to join your spouse or will you be remaining in your home country/returning to Canada?

Greenie,
Thank you for your reply.

I am applying for a new Tier 2 Visa (Partner) as I think that my current Tier 2 Visa is no long valid as long as my husband has changed his employer and he got a new Tier 2 Visa with new COS number.

As for my current plans, actually, I was planning to visit my husband and stay with him for like 2 weeks before I go back to my country (In this case I will change my ticket). However, if my current visa will not allow me to enter UK, then I will return back to my country transiting via London (as per my original ticket).

If my visa is not valid any more, then in this case, I can't even transit in UK as I can't apply to any visa from Canada as long as my Permanent Residency Card has expired.

As for my future plan, yes, I am planning to join my husband after few months and when I go to my country I will apply for Tier 2 visa under the new employer.

As soon as I leave Canada, I will not be able to return except with a travel document obtained from the Canadian Embassy in the country where I will be in (home country or UK).

Kindly advise...
