I have been working in the UK for 3 years (since Nov 2006). I am on a 5 year work permit, valid till Nov 2011. Recently I attended an interview with another company, and they are keen to hire me. They said that they are ready to sponsor my Tier 2. I had a few doubts in mind, which I wish to clear off before going ahead with anything.
1) Obviously, I wish to not inform my current employer till the time I know for sure that my next job is secure. So, if my prospective employer goes ahead and applies to the Home office for a sponsorship certificate, will my current employer be informed by the home office ?
2) Can the entire process of changing the job/sponsor, shifting from work permit to Tier 2 be done while I am in the UK ? Or do I need to do this from my home country ?
3) Will I have to apply for new visas for my wife and kids (who live with me in the UK as dependents)
4) Any more advice from people who have gone through the same situation is very much appreciated !
Many thanks in advance for your time !

"If you have permission to enter or stay in the United Kingdom under tier 2, you can apply to change your job either in the same organisation or in a new organisation. You must apply again and meet all the points' requirements.
You will not have to resend evidence of your English language or maintenance (funds) if you have already proven this in your first application. If you not have already sent evidence, you must send it or your application will be refused."

Thanks meats.

I am still on the old "Work Permit". Though, I do qualify for points under the new Tier 2 system. So would this mean I can do all the required Tier 2 processing while remaining in the UK ? Or will I have to go back to my home country and re-apply ?

NO, HO will not inform your current employer but IF they need to verify any earnings or previous WP status, they may contact your current employer (but it is not mandatory);
2) Can the entire process of changing the job/sponsor, shifting from work permit to Tier 2 be done while I am in the UK ? Or do I need to do this from my home country ?
YES, it can be done while you are in UK and you can stil be working for your current employer while the process is completed (by process i mean: Sponser License for your new company if they dont have one already, Advert of the position, Certificate of sponsership, Application for your new Tier2(G) Visa)
3) Will I have to apply for new visas for my wife and kids (who live with me in the UK as dependents)
YES, you can apply for new Visa for your dependents along with your application
4) Any more advice from people who have gone through the same situation is very much appreciated !
Many thanks in advance for your time !

Brilliant reply, thanks a lot tvn Ramesh !
Could I trouble you with a couple more of quick questions please -
1)In some other threads on this site, I read some applicants mentioning that their Tier 2 visa was refused because the salary offered was low. When does this refusal happen ? Does the HO refuse to give the prospective employer a certificate ? or does the HO issue a sponsorship certificate, and then goes ahead and refuses the actual visa applicant ?
2)Is there any website/link where I could pre-check if the salary I am offered is appropriate for the entire process to go through smoothly ?
3)I remember reading on some site (not sure where though) and also a couple of people told me that you will need to get out of the UK and come back in (even if it was for a day), so that immigration guyz can put u on their systems as a new visa holder with the changed status. How true is this ?
Many thanks again for your replies !

- Yes the Salary should be given as per the CODE OF PRACTICE (sorry i did not mention in my earlire msg) please check the link below:

HO refuses at the time your application (last stage) - good way to get more VISA Fees into their kitties..

- No there is nothing like that.. when you visa is issued everything is gone into their systems.. if the above is the case then all those who got extensions in UK wil be out of system and out dated - it is not logical anyway..
Many thanks again for your replies !

Hi,
Hope everything went well and you are settled well in your new job. I am in exactly the same situation, I'm offered a new job at another compay, the role is the same but higher position and salary. and I don't want my current employer find out until I tell them once everything is sorted.
I was woundering how long did the process of switching CoS take and how long did the process take afterwards?
Thanks & Regards,
T
