HELP!! Child born in Pakistan to ILR, wife visa in appeal.

HELP!! Child born in Pakistan to ILR, wife visa in appeal.

I am in a difficult situation, I have ILR and I am settled here in the UK. I got married in Pakistan and applied for my wife but visa was refused due to accommodation issue.

Now my wife is pregnant and the baby is due shortly but the visa appeal is at the end of January. I am not sure what to do regarding my child?

I would be grateful if someone can help me out. I have asked around and checked everywhere but i am not getting the answers. My questions are

1) When I will go for appeal and the appeal is allowed, will the Judge instruct Home Office to issue visa for my wife and my child, are there any forms to fill before i will go for appeal because my solicitor said he will inform the Judge about the child?

2) Do I need to apply for my child from Pakistan when I will send my wife's passport for visa after the appeal is won, which forms to fill in ?

3) Do I need to make a Pakistani passport for the child and then apply for the visa? ILE (Indefinite leave to enter) or I can simply enter the child's details on my wife's or my passport?

I am not sure about the procedure to bring the child here when the child is born abroad, can someone please help me out here?

The appeal is that of your wife ,not about the unborn child

2) Do I need to apply for my child from Pakistan when I will send my wife's passport for visa after the appeal is won, which forms to fill in ?

Yes, you have to apply for visa seperately for your child, but will have to wait the prescribed period till they grant visa. It will not be done at the same time as your wife will get her visa stamped on her passport providing you of course win the appeal

Yes you have to make seperate passport for your child now as he can not be entered on yours or your wifes passport

You may not be,but your solicitor should be. Thats why you are paying him to represent you at the hearing.
