Help for brother married to french citizen

Post by slgslhslg » Fri Nov 06, 2015 9:50 pm

hi everyone,

i hope someone can help, my brother is married to a french citizen for more then 3 years now (has got dependent visa for more then 3 years). he has a son with her who also is french. Both of them (my brothers wife and child) dont have british nationality. Recently they have been having lot of arguments and things it seem to me are going toward point of no return. I have 2 question hopefully some one will be kind enough to answer please:

1. If they get divorce then is there any way my brother can stay in UK?
2. If his wife after seperation take his son to france then in this case can he do any thing?

Please help - Thanks

You brother may be able to retain his right of residence after divorce, based on the circumstances of his case that you have explained.

He may seek a coury order preventing their child from leaving the jurisdiction and as part of a divorce settlement, he will be obtained a chid arrangement order requiring that contacts and access to the child take place in the UK.
