Help for the eligibility for registration under MN1 category

Hi All,
I have received ILR under 10 year long residency rule in February 2011 and my wife is still on Tier 1 dependant visa. My daughter was born in the UK in June 2007 and then went to India in February 2008 to live with my parents and came back in May 2010 to live with us here in the UK.
I phoned the nationality helpline two times on two different days. One advisor told me that my daughter can apply for registration using MN1 form and my wife’s visa status is irreverent and only one parent needs to have ILR.
Other day second advisor told me that she cannot use MN1 form because my wife does not has ILR and case worker would like to see both parents’ ILR.
While making those phone calls I did not mention about my daughter’s absence (more than two year) from UK.

Could somebody advise me on whether I can apply for registration for my daughter using MN1 form or I need to get FLR(M) visa for her with my wife.
