Help on ILR

Post by BSK » Thu Mar 17, 2011 12:27 pm

Hi Guys,

I would be very thankful if you could clarify some of my doubts.

I entered in UK on WP in June 2006. I got HSMP before Nov 2006 and covered HSMP JR Policy document.

My son was born in UK in Feb 2008 and I applied for Indian passport and got him registered as Indian national. Then I went for HSMP VISA renewal in Nov. 2008 and got Tier 1 (G) VISA for all of us and it covers until Nov. 2011. We made a couple of trips to India during last year. I just wondered whether I can apply for just for me and my wife and after getting ILR for us thought of registering my son under Registration of a minor as a British Citizen. I can apply for 'Person of Indian Origin (PIO)' card for my son in case of emergency India trip.

Guys,

I have a question regarding my son' visa.

As mentioned earlier, I am planning to apply for ILR for self and my wife with out including my son, who born in UK. I am planning to register him under registration of minor as a bristish citizen. I heard that getting UK citizenship could take 3 weeks to 6 months. In mean time, if I need to visit India, let us say, for a emergency trip, Will there be any problem as my son's passport has got visa as HSMP dependant.

I knew that as long as if you are remain in the UK, there are no issues.

My question is that if I change my visa status to ILR from HSMP would that mean depandents will loose their visa status if you want to travel back from India.

Thanks,
BSK

I would have thought that as soon as you change your visa to ILR, your family's HSMP depedent visa becomes invalid. so travel might be a problem. Look at the link below:
