HELP!Ive got 21 days left to appeal for my wifes depend visa

Post by godwindaniel » Mon Apr 16, 2007 10:06 pm

hello and thankyou to all the ppl behind this forum.

I would like to start with my history.
-applied to a masters degree at the university of greenwich and got admission and applied and got a student visa on sept 2005, i was sponsored by my parents. visa was valid till april 2007.
-finished the degree sucessfully in 1 yr and now awaiting for graduation which is due in couple of weeks.
- after completing my course went back to india in december 2006 and got married & came back to study mba which was sponsored by my wifes uncle, since i came back im staying my wifes uncle(he fathers brother) place and got visa extended till april 2008. i sent my docs bac home after i got it extended.

The refusal letter states:
"I note that when your husband was issued a visa in september 2005 he was issued to go and study a MA in Marketing at middlesex university and was sponsored by his parents. The covering letter that you have provided shows that he is now studyung at cambrufdg college and he has provided no explanation of why he swapped course and educational insitute, furthermore there is no evidence that he has ever studied at middlesex university.Your husband was issued a visa on the basis that he was supported by his parents and would study at middlesex university, on the evidence before it appears that your husband has not kept to the conditions under which they were issued a visa."".......

and so and the eco says he doubts the credibility of the application.
Im thoroughly amazed how on earth did middlesex university came into the picture, its always been university of greenwich, it appears to be either eco has looked into the wrong record or its his imagination. I shud have shown proof of my prev studies as well but however hte high commision sshould have details in its immigration records which seem to be faulty.

Could anyone please let me know whether I should appeal or reapply. I heard that appeals take upto 6 mths,my visa expires april 2008 and me and my wife really wish to be together this summer.

Please help......if at all the appeal could be expedited can anyone direct to a good advisor.

Thanking you
Godwin

Why not reapply and include evidence of the completion of the first masters degree? You could wait for the certificate after your graduation or get a letter from the university stating that you have completed your course. Then you could get another letter from the university detailing the start date etc. of the current MBA.

Since it is obvious that the ECO has confused the issue, a clearly worded cover letter may be in order, this should highlight the error in the previous decision regarding the name of the university etc, make it clear that you have completed the first masters degree and point out that you have included evidence of this.
