Help needed- FLR(M) awaiting consideration since 24/Jun/06

I am Indian Citizen(Mr Ash) married to British citizen in June 2003 on Work Permit since the begining.

We decided to settle down in UK and applied for FLR(M) on 20th June 06.

I received letter from HO that my case is being passed on to case worker who will be working on my case. since then I am awaiting my passport.

I am with a indian IT Employer on WP to UK and my current employer want me to move to India and hence I started looking Job in UK and found two very attractive offers, this new empoyer has asked me for Visa documents which is till with HO for processing.

I have seen on IND website that the MAX timeframe for this visa is 14 which is this week...I am worried that I will loose the new offers If I do not get the visa from homeoffice before this month end as the new offers is out since the MID of Aug.

I am desperately trying to find out the processing times for FLR(M) visa. When called HO they told that it is still awaiting consideration.

Also I need to travel to India in second week of Oct 06.

I need help to know if this is a normal case or is ther anything that i should do to get my passport with visa stamp back to enable me to accept offer from new employer and travel to India.

You can show this portion of the statement I am posting to the prospective employer with a copy of your current LTR and they should be able to employ you:
Your immigration status while your application is being decided

If you make a valid application before your permission to stay ends, your existing immigration status will continue until your application is decided, even if the decision is not made until after the end of your permitted stay. If your existing visa or other permission to stay here allows you to work, you can continue to do so until your case is decided.
Also I need to travel to India in second week of Oct 06.
HO clearly states that you should not make any travelling arrangements whilst the application is being considered. You can withraw your application, travel to India and when you come back re-file the application. Note that you would loose the initial processing fee and would have to pay again.

You can also download the form at the link below and fax it to the relevant office with reasons why it should be speeded up.

Thanks for the reply.

As I am planning to leave my current employer who sponsored my WP, I cannot work for any other employer and hence Applied for FLR on a marriage basis which will enable me to work for any UK based employer. Also this new employer is keen to see my ILR visa before moving ahead with employment and hence I am in a fix given the delays from HO.....I AM WORRIED FOR HOW MANY MORE WEEKS I NEED TO WAIT...any help on above will be great moral boosting for me.....thx

Show them the letter you received and tell them they would have to wait until you receive the response or your passport back. If they can keep the job until your ILR comes through then fine but they are not under any obligation to do so.

I believe since your WP is not an open one but rather employer specific, you cannot just changed jobs although your current application for FLTR is being considered (If I am wrong, John, Kayalami and co will clarify).

Did you consider filling out the form on the link I provided? That can speed up the process and tell your employer the actions you have taken.

Your best option is to sit in with this present employer till your ILR comes through then you can find another job. If you have the right skills, there is nothing to worry about.

HI,

I have faxed the form to HO......also, called thme they told me that even though my case has completed 14 weeks as stated on IND website...the processing may take longer then that...but how much time they didn't informed....as I have to travel out of UK by 15th Oct for sure....I am worrie If I do not receive my passport by that time then I will have no other option to withdraw my application from HO :(
