help needed -- PSW visa application & overstay

The following is my story. Will my application be refused if I apply for PSW visa? What can I do in this situation?

My visa expired on 10 Nov 2010 last time. On 8 Nov 2010 I successfully passed my PhD viva, which meant that I would be awarded doctor degree. Thus I applied for a PSW visa on 10 Nov 2010.

On 21 Nov 2010 I received a letter from Home Office saying my application was invalid, because they couldn’t take a payment from my card and “if you still wish to make an application, you must return your fully completed application form with the appropriate fee to the address given on the application formâ€

Acceptance of an out-of-time application for processing is subject to UKBA discretion. The mere fact that an out-of-time application is accepted for consideration doesn't make any period of unlawful stay legal.

A 12 month ban from the date you exited UK applies (320(7B)).

Did you find out why they couldn't take payment for your initial application?

12 month ban from the date you exited UK applies.

What is the date do you think I exited uk? 5 Feb? How to count the delay due to their wrong refusal letter sent?

I don't know. My card seems working well.
