I came to the United Kingdom at the age of thirteen 11 years ago and since I have been in this country, my brother who is a British national has been the one looking after my welfare and also the one providing me with an accommodation as we both live together with his wife and children (all british) as I don't have a father.
However, since I have been here, I have been able to attend high school, sixth form, college and I obtained my university degree.
Since I have been in the United Kingdom, I have never taken any form of benefits neither have I pertained in any form of crime.
Having lived here for 11 years I have been able to develop family ties in this country as all my close relatives including my mum, brother, my sister, my in laws, nieces, nephews, cousins, aunties and uncles are all settled here.
Although my mum is not settled here at the moment, though she used to have an indefinite stay which she lost and she was a victim of identity fraud and recently the judge granted her permission for judicial review which she is waiting for a court hearing date. In addition to the family ties that I have with this country, I also have social and cultural ties here in the UK as all my friends are all here as I have spent most of my teen years here and my early adult life which I cannot imagine life without them as they have all been there to support me morally, spiritually, physically, mentally, academically etc
In January, I applied for a leave to remain in the UK with many support letters from my family members but the application got refused as the home office are claiming I still have relatives back home which is not true. They also claim that all the relatives I claim to have in UK including my brother, sister, inlaws, uncles, aunties, nieces, nephews, cousins etc are not classified as having a family life in the UK. I'm not married, I'm just a young adult of 24 and those are the people have known as my family. I wasn't given a right of appeal as well.
Wrote a pap but the Home office are still sticking to their refusal saying I'm an adult and but all my family here here. I've used 11years and 3 months here and 16 months always from living half of my life here.

Please can anyone help me out here on what I need to do. Thanks

She came to the UK in 2004 on a student visa, along the line she tried to renew by visa which was granted and when She tried to renew again She was refused in 2007 and ever since, She has been living in the UK. She met my partner in 2008 and they have be cohabiting since then. In 2012, She applied in order to regularise her status, during that period she and her partner got married, which they informed the home office and sent pictures and their marriage certificate but that application got refused.
They were advised to go for judicial review, which they had an oral hearing that was adjourned due to the fact that their solicitor was not allowed to talk in the court as he's not a barrister. During the time of adjournment She got pregnant and was advised to withdraw the judicial review as the pregnancy won't be considered with the application.
So they decided to put in a new application in January but home office kept returning the application saying there was no payment and pictures which was not true but when their solicitor threatened them with judicial review, they sent a biometrics letter and after a month, they requested for her medical reports in order to confirm the pregnancy and the due date but after 2 weeks She got a refusal again saying She should go and give birth in Nigeria and there's no reason why her partner can't relocate with her and should go and get an entry clearance. Her partner is full British as he was born here and all his family members lives here too.

The problem is, you would have live jalf of your life here, but you will be over 25, so it is the 20 years rule that they will seek to apply.

Fight the fact that proper consideration has not been given outside the rules.

Yea that's the thing, by that time I will be 26. How do we fight the fact that proper consideration as not been given to my case. Any suggestion on the merit I have to this case please.

If those 46 members don't have the answer there's no point in them replying to you. The reason the question has been asked about the birth of the baby is that it would strengthen an application. She may have an additional problem however if NHS facilities are used for the birth, ie. not paid for.

You may have a strong claim outside the rules, but within it, it is very hard. You will have to seek JR, and get the UKBA to make a removal decision andvtry fighting at the tribunal, or wait for a bit, while you accrue 20 years.

Well a JR can be put now or you can wait until the Autumn, when the baby is born. That may strength her case, and she will have a compelling reason to ask the Secretary of State to ussue a removal notice, which will come with a right of appeal.

I'm sorry to bother u again, I was seeking advice regarding my case and someone suggested this

About waiting till I get to 20 years I don't really wanna wait that long and i rebuke that In Jesus Name, as life is really tough when u don't have an income and especially living with people. We all want her freedom which I can't wait to get and move forward with life.

I've used 11years and 4months here and 15 months away from living half of my life here.

They have lodged an acknowledge of service saying they want to contest all claims. Please what do you guys think about my case, I know God is a miracle worker He has done complicated than mine before so He can do this

I'm going to take one try at this before I walk away as I get a sense this is going to wind me up.

I don't fully know what the_silk_road is going to be driving at yet - but you have someone who has posted and asked a question - which is an apparent step to be willing to engage and help you.

You've chosen to ignore that and expect an answer based on exactly what you've put.

It's entirely possible that the question asked is going to reveal an answer you never knew or understood. It's also possible it'll make no difference. You won't know unless you engage. At the moment you're choosing to ignore.

You should apply under 276ADE (1):

(v) is aged 18 years or above and under 25 years and has spent at least half of his life
living continuously in the UK (discounting any period of imprisonment)

I assume such a time is approaching soon. How old are you exactly and how long exactly have you been in the UK?

Been here for 12 years since I was thirteen and I'm 10 months short of using half of my life here though all my family member lives in the uk and I'm not married neither do I have any kids. I've schooled here up to university level just trying to regularise my status
