Help please - EEA Family Permit for Extended Family member

Hey, guys, could you please help me out with my father's application.

Circumstances:

1. I am British now, my husband is British who has been working in Germany for 7 years

2. I never live in Germany with him but visit him some time, our home is still in the UK and my husband cames back to the UK every weekend

3. I have been supporting my parents back to India for the last 10 years. They have lived in my property for the last 10 years. I have evidence to prove that I transfer funds to my father for last year.

4. My mother passed away this March, I applied 2 years family visitor visa for my father . So my father is now living with me and my husband's home in the UK.

My questions are:

1. Can I apply for EEA family permit for my father?
2. If the answer is , can this application be made inside the UK?
3. Do I have to stay with my Husband in Germany for a period of time to become qualify?
4. Does my father have to stay in Germany with us for few days?

last question, if my father has not got valid visa, is he entitled to make application inside the UK, will his application be refused on the ground that he has not got valid visa?

Sorry , so many questions.

Any answer will be greatly appreciated!!

I think as u live in UK the application will be under UK rules. EEA rules would only apply if you lived in Germany or had done so for six months and returned to UK. In any case this ruling (surinder singh) only applies to non-eea spouses AIUI.

My husband is living in Germany, we have rented appartment there. What kind of evidence is required to prove that I live in Germany for more than 6 momths?
