Help Please

I am on PSW, was issued in Jan 2009,
Went to my Home country Pakistan, Got married with a Pakistani National.
She came in UK in June 2009 as my Dependant (PSW).

Now we are feeling like, Can not live together and i want to give her Divorce.
If I give her divorce, Will her visa be cancelled? Will she be deported Straightaway? What will happen to her Status?

Please Advise

1. If u divorce her then she shud leave the country asap as she was u dependent and if u leave her then she has got no right to be in the UK.
2. If you do not report that to the HO then it will effect u immigration history for not declaring that u have left u partner.

if she want to leave here... transfer her to Tier 4 student Visa..then u can be sepearate.. and u declare to home office.. then it will not affect her status..

But avoid getting divorce.. May God put blessings ...and try to be together..

Life is Test.. May be 25 Yrs or 30 Yrs or 40 or 50.. one day we are liable to God.. :(

Why avoid a divorce if he doesn't love her and maybe wants to move on and find another partner?

If you divorce or separate then your partner has no right to be in the UK as she is your dependent. You must report this to the Home Office otherwise it will look bad on you if you fail to report her and wish to extend or apply for another visa in the future.

Yes she can..

get admisson.. some where.. and ask the concerned UNI or college..they will guide u ....but she can study here too.. on dependent..

in both case u have to declare that u have divorced her...

change the status and then do what ever u want to do..

I don't think she can change status as her visa would be invalid if they are divorced or separated. She would need to go home and apply from there for a student visa.

Not telling the HO that you have separated and she studies on her current visa will look bad on you and could lead the HO to believe that you are deceiving them and get you a ban in future.

Why would she change her status when as a dependent she can study anyway?

If she wants to change status to student visa then she will have to apply from her home country and after the HO has been notified that your marriage has ended.

If your marriage does end and you fail to notify the HO then there is a good chance that any future application that you make will be rejected based on your previous deception regarding your marriage breaking up.
