If you are married to a British citizen, then you may be eligible now. Why wait?

It should be okay to apply with an expired passport, if you have proof that you haven't been outside the UK on a new passport.

Hi

Thanks for your reply. My wife won't support my application so I will wait another year it's okay for me. About the passport I won't renew it I will apply for BC with the expire one is that okay or do I need to show them new one because I won't apply for one.

Should be okay, subject to 2. Checking the residence requirements. However, it's probably more straight forward if you can produce a new passport or if your embassy can confirm that you haven't been issued with a new passport.
