Hi
My fiance obtained a ECC form canada and entered the UK correctly about 3 weeks after the Entry clearence was issued, We married in January2007 and sent the application to the home office to obtain the leave to remain.

Problem..

It seems that the entry clearence cert expired after the marriage which was OK but a few days before the home office recieved our application. The have sent her a "refusal of leave to remain" letter which says that she must leave the UK or be fined /jailed/removed etc.
They also say that there is NO right to appeal!!

HELP. What is the right procedure to fix this, to be sent back because of a 5 day overstay is crazy. we meet all the requirements for income ,housing etc and this is the only problem we have.

Hi

Just a note to say that I have resolved my problem with the immigration people.

It seems that our application was denied because we were a few days past the expiry date of our fiancee visa. our case was sent to an enforcement officer who gave us plenty of GOOD, CORRECT and USEFUL advice. we contacted our MP who was not so good!. My thanks to this lady. .

We sent a letter to the home office dept. that refused our application asking them to reconsider our case even though the letter from the Home Office stated NO appeal was allowed. we sent details from the Immigration caseworkers instructions that were relevent to our case.
2 weeks later we received my wifes passport back with the LLR visa in place.

It just shows that you can win sometimes : :D
