PR Help

Post by NAPVS » Tue Oct 15, 2019 5:26 pm

Hi,

I am currently on Tier 2 general visa ( 3 years 9 months). Before I got my Tier 2 general I was on Tier 1 General visa.
Wanted to know if I can apply for PR under 5 year work permit and show 3 years 9 months from my Tier 2 visa and remaining 1 year 3 months from Tier 1.

Or it has to be 5 years from one category ?

Thanks

I think you can combine the time in Tier-1 General & Tier-2 General to meet the 5 years requirement. However, note that there has been many rejections for Tier-1 General recently if the home office sees a discrepancy between the income declared in Tier-1 General visa and the income declared to HMRC for tax purposes. The rejections have been based on section 322(5) of the immigration rules. If this is the case, it is safer to wait to apply solely based on your time in Tier-2 General. Note that if you get rejection now based on section 322(5), it is likely that your future ILR applications, based on any route, will also fail. I am not sure if this had applied only for those with a history of Tier-1 General extension application or not, as I have never had a Tier-1 General visa. Better wait for others to respond.

You do not get PR as a non EU citizen, you must apply for ILR. And you can include time spent under Tier 1G. However if you had any tax issues under Tier 1, they will affect you when applying for ILR
