HELP! VWP denied, probably because a B2 was denied before

Post by jillackermans » Sun Feb 01, 2009 2:08 am

Hi,

I am desparate need for some good advice. I am a Dutch citizen and passport holder, and have been deinied both the B2 visa and the VWP, in that order.

I am currently in Australia and wanted to go to the USA next month and therefore applied for a B2 visa a bit more than a week ago.
They denied this. At the consulate they told me that this was because I should have done this while I was in the Netherlands. In the letter that I received it actually said that it was because they found insufficient prood that my intention was to leave the USA again after 6 months.

So I changed my plans and decided to only go for three months instead and applied for the VWP online through ESTA.
I did this yesterday and it also came back negative. I think that it is because I had to answer 'yes' to 'Have you been denied a visa before?'

I have been 100% honest with them, I want to and will go back to the Netherlands. What can I do to change my situation?

Thanks in advance for your help.

Kind regards,

Jill

It was not a very good idea to apply for a B2 in the first place, since you were eligible for the VWP. Now you have no alternative except applying for a B2 again, providing sufficient evidence of ties to wherever it is you're living.
