Hi,

my husband was initially refused a visa on the grounds that the ECO felt we had submitted fraudulent documents as well as my divorce from my previous marriage was not genuine (even though this is not true).

He had an appeal hearing last month and was refused by the judge as well.

We have now decided to submit a fresh application and leave out the documents which they felt were bogus as they were not that relevant anyway. We only submitted them as we wanted the case expediated which never happened.

I now want advice and help on filling out the application form the right way and also overcoming the barriers with regards to the divorce from my previous marriage. My spouse has never been married before.

If there is someone who can help me do this please either mail me or call me me on 07985326384.

Any help will be really appreciated as I have spent thousands on solicitors and flights and now am totally broke so I am hoping someone from this forum might be able to advice me.

Saw your other posts as well and it may be easier for the forum to discuss your case if you actually continue with the previous thread.

Spouse visa (with following documents and proofs) for someone married to a British citizen should not be that difficult unless there are other issues. Anyway a brief list (not exclusive) of documents required are:

1. Marriage certificate - original
2. Original divorce certificate (if previously married)
3. Accomodation
4. Funds

The easiest way to fill in the form is to fill it in truthfully and anything you say has to be proved with appropriate documents. Previous marriage is NOT a problem at all, if you have the original divorce certificate.

thank u. I am quite concerned that the ECO stated that upon making enquiries she found the divorce certificate not to be genuine. How can I go about proving that. I mean how do they distinguish between a genuine and fraudulent document. Is it worth me getting in touch with the union council in pakistan who issued it and seeing if they can write me something to confirm the genuieness of this certificate, or shall I just submit it exactly the same way it is and keep my fingers crossed.

A solicitor I spoke to here adviced me to start divorce proceedings here in London and get my husband over as a fiancee. But will that not make them even more suspicious, that I initially submitted application for spouse and now I am changing to fiancee??
