Dear Home Office, I am currently Separated from my ex wife not divorced yet. We married in 2010. She is no longer living with me. I know I can apply for settled status but my separated wife won’t give me her ID or passport and residency proof for 5 years. *****************
1) We have Joint account in the Bank and Account shows her name and my name on the statement. Can I use that statement for residency proof ?...................................
2) What can I do if she won’t give me her photo ID ? Do you accept photocopy or scan copy? I don’t think she is applying for settled status anytime soon I need to apply for settled status because my EU residence card expired

Thank you for your question regarding how to apply to the EU Settlement Scheme.
The EU Settlement Scheme enables EU citizens and their family members to apply for their UK immigration status after the UK leaves the EU.
As a non-EU family member of an EU citizen, you would be eligible to apply for the scheme. Because your status here under EU law as non-EU family member depends on your current or past family relationship to your EU spouse resident in the UK, you would also need to provide evidence of that relationship for the relevant period, the valid passport or national identity card of that EU citizen and evidence of that person’s continuous residence in the UK during that period.
However, we will accept alternative evidence of your EU family members identity and nationality where you are unable to obtain the required documentation due to reasons beyond your control, or other compelling and practical reasons.
Due to your circumstances, some evidential flexibility may be possible. Our caseworker would work with you to provide the correct evidence and would be in touch if what has been provided is not acceptable.
In terms of proving residency, a bank statement with yours and your partners name on, showing activity in the UK would likely be accepted by a caseworker so long as it covers the necessary period of residency required for the scheme. Furthermore, if you are unable to obtain your spouse’s ID document, we would recommend uploading a scan or photograph of it as evidence (where possible) and this would then be considered by our caseworker.
We would also recommend, if possible, providing a cover letter (this can be uploaded as evidence) explaining your situation so that the caseworker assessing your application is aware of your situation.
