HOT TOPIC-New application as parent of a child in UK

Post by redeve17 » Wed Jan 22, 2014 4:20 pm

Hiya Guys,

Please help with comments and not just viewing, has anyone applied under this parent of a british child route using form FLR(O) which has recently been changed to form FLR(FP).

The requirements are very clear but am confused on how to meet the below:
(i) sole parental responsibility for the child, or that the child normally lives with them; or or I do not have sole responsibility for the child since the father and myself are amicable and we make joint decisions on the child, but at least the child normally lives with me.

(ii) access rights to the child; and for access rights I read on ukba website They should show evidence from a UK court that they have access rights to the child. Residence orders or Contact orders granted by UK Courts, or a sworn affidavit from the non-applicant parent, (that is, the U.K. resident parent or carer of the child), confirming that the applicant parent can have access to the child, and describing in detail the arrangements made to allow for this access, are taken as suitable evidence of access rights. (If contact is supervised, then the statement must be sworn by the supervisor). The relationship has only recently broken down 2 months ago and am trying to avoid any arguments/fights by bringing up filing for access rights with my ex, I am confused on how I can meet this access rights requirement since I do not have a residence order/contact order or letter from ex and I cannot get this.

(b) The applicant must provide evidence that they are taking, and intend to continue to take, an active role in the child's upbringing. How do I prove this?

Thanks for your help
