I, 35 years old, completed MSc in Science stream at the University of Leeds in Sep, 2007. My student visa got expired in 01/2008, after which I switched into "Limited Leave to Remain" visa under International Graduates Scheme, which was initially offered for 1 year. In July 2008, that rule was changed and IGS can be extended for 1 more year provided that the applicant had £2000 continuously in his account for 3 months. Unfortunately, I came to know about this change of rule at the later stage only. But still I applied for the VISA extension stating that I had enough money in my account in India. The Home office refused to accept it and my visa extension was refused and it was intimated me to by post only on 25/03/2009 (My previous visa expiry date - 16/02/2009). My friends asked me to appeal, as some judges are lenient in this kind of cases and one of my friend got success on his appeal for the same reason.
But the appeal also got rejected. I applied for reconsideration at the High Court and the final rejection decision was made on 19/11/09, which was informed to me by post only on 02/12/2009 and I left the UK on 30/12/2009 (at that time a lawyer informed me that 28 days will be counted from the date I receive the post). Nothing happened at the airport on my departure from the UK.
Now I want to return back to the UK to do anther MSc or MRes (masters by research), as my professor of Leeds is willing to sponsor me a PhD provided that I prove me once again.
Now please answer me the following…
1. Did I overstay?
2. Will my past appeal history affect my future VISA application?
3. Am I eligible to do another MSc or MRes? I came to know that applicant who is applying from their own country no need to prove progression rule. The University of Huddersfield is ready to offer MRes but Glyndwr uni rejected my application for MSc Aeronautical Engineering stating the Progression rule.
4. How to fill the Visa application for the following questions (I am not able to understand the nuances)?
a. Have you made an application to the Home Office to remain in the UK in the last 10 years? ( I hope YES should be my ans)
b. Have you been refused entry to the UK in the last 10 years (for example at a UK airport or seaport)? (NO should be my ans???)
c. Have you been refused a visa for any country including the UK in the last 10 years? (Yes should be my ans???)
d. Are you, or have you been subject to, an exclusion order from the UK? (No should be my ans???)
e. Have you been deported, removed or otherwise required to leave any country including the UK in the last 10 years? (Y or N???)
f. Have you ever voluntarily elected to depart the UK? (Yor N???)
