How long have I got once my Visa is refused?

Post by hsmp28122006 » Sun Jul 13, 2008 9:24 pm

Hi All,

I am on Work Permit in UK which is going to expire on 18th July. I have filed Tier 1 application on 23 June and result of this is not expected to come before my workpermit expires. What if Tier 1 application is refused and workpermit has already expired?
1) Would I be required to immediately leave the country? Or, would I be give some time do leave country?
2) What if my employer wants to apply for workpermit once Tier 1 is rejected? Would I still have to leave the country?

Cheers!

UKBA usually grants a 28 day period to leave the country.

I don't think an in-country WP application (and an FLR application) can be made once your current leave has expired. Your employer will have to make an out-country WP application and you'll have to apply for EC from outside UK. But I am not 100% sure, so will let others correct me if I am wrong on this one.
