How much delay in travel is permitted after Tier-1 issuance?

Post by mm11 » Tue Dec 14, 2010 8:04 am

Dear members,

I am planning to apply for Tier-1 (General) soon although if I get the visa, I do not plan to travel immediately. I plan to stay in India for the time being, and plan to go to UK after 6 months or one year. Is such a long delay permissible? Does such delayed travel have any bad consequences? Will it cause problem when I’ll apply for an extension in the future?

Many thanks for your advice.

If you do not travel within 28 days, you will need to renew twice before getting ILR. Other than having to renew twice, you should not encounter any issues.

On that however, it's difficult to predict the future and they might have to put something into place whereby they phase out extensions. According to the currrent rules you should be fine, but if they were to decide to start phasing out extensions, it might affect you. Unfortunately there is no information out there to indicate wha tthe future will hold and anything anyone will tell you would be pure speculation.

So, if I just travel to Uk within 28 days, stay there for few days and come back to India and don't go to UK for 6 months to a year would that be fine or even in that case would I have to renew when I would plan to go to UK after a stay of say 1 year in India?

I am sorry for being ignorant, but what exactly do you mean by renew? I mean renew what? How would this renewal need to be done? What is ILR?

Thanks

Renewal is if you want to extend your stay beyond the original two years you will be granted (I use the terms interchangably but the correct term is extension). If you want to make the UK your home and become a British citizen, you will need to apply for an extension to get 5 years. After 5 years you can apply for ILR (Indefinite Leave to Remain) and then eventually this leads to citizenship. If you don't intend on settling there long-term then don't worry about it, you can then just travel when you wish.

There are many things to consider and I suggest that you figure out what you want to do with the next five years of your life, unless you are just doing this as a bit of an adventure. Read up some more and figure out how you want to achieve whatever your goal is, because one post on here is not enough to explain it all.

Hi,

Thanks for this information.

Though presently I am not prepared to predict my future preference, but the five years option that you are telling seems interesting. My question is, that if I want to keep the '5-year extension' option open without having to renew twice, but I don't want to start living in UK immediately but after many months from now, then would a temporary travel and short term stay (of lets say 7-10 days) during the first 28 days be enough or do I need to spend longer time in UK starting from the first 28 days?

Thanks again

If you travel to UK within 28 days after your visa grant date AND you will not be outside UK for more than 180 days in next 5 years time, then you won't need to apply for 2nd extension for ILR.

If any one of the above fails, then you will ahve to apply for 2nd extension, meaning that you can only apply for ILR after 7 years.

Hope this helps.
