How to prove I applied for visa before expiry of old visa

Post by nadeemshafiq » Sat Mar 19, 2011 11:00 pm

Hi,

I will be applying for ILR soon and have a concern regarding the continuity of stay.

I applied for HSMP on 23 January 2008 before the expiry of my Work Permit on 29th February 2008.

As my leave to remain was due to expire on 29th February 2008, my lawyer applied for FLR before the decision of HSMP to prevent me overstaying.

My HSMP was approved on 20 February 2008 and my FLR was stamped on 14th March.

My question is that how do i prove that i did not over stay (29th February to 14 March) as the letter I received with FLR acceptance does not state that the application was submitted before 29th February.

Thanks

Did your lawyer keep the proof of posting? May also apply for SAR file.

Normally UKBA sends an acknowledgement letter after receving application. Ask your lawyer for a copy.

Getting information from lawyer at such a short notice is impossible and he is not the most efficient in responding to my emails.

I believe the application was made prior to visa expiry and expect visa officer to check their records carefully when considering my application. I just wanted to add extra evidence to help visa officer which now looks difficult.
