HSMP b/n April2006 & Nov2006- ILR&citizenship

Dear all,

I came across this very useful forum for people like me. I would be very thankful if anyone could advice me.

My husband got Hsmp visa for 2 years in Nov. 2006. He comes under after April 2006 and prior to Nov 2006 rules. Under the legitimate expectation rules he got his extension for 3 years in Nov 2008 without any problem.

It is very confusing with the new ILR and citizenship rules. As he comes b/n April 2006 and Nov 2006 rules can anyone kindly clarify our situation about ILR and citizenship.

Are we eligible to get ILR in Nov 2011 and citizenship in Nov. 2012 (if he comes under old rules). Please correct me if I am assuming wrong.

If you could kindly clarrify this we could live in peace till then.

Five years for ILR. As for citizenship, the rules in force at the time of naturalization will be applicable.

The promise on which the legitimate expectation is based (as per judicial review judgment) was regarding settlement (ILR) only. There was no promise regarding naturalization in HSMP (and neither is even in Tier 1).
