Even I am in the same boat as you. I am now qualifying for Extension just in border, even slight worser side will disqualify me.

But dont worry even in that worst secenario we can over come if our employer is really supportive.

If we are short of 1000£ to 3000£ income that can be informed to the company, that can be earned by Overtime work / Bonus if our company supports us. Overtimes are counted for income

Even if that is not possible we can switch to work permit ( I hope transitional arrangements will be there)

The most most worst case is loosing the job itself. Because even a one month break in job will proove fatal now. Until we are in some job, I think there are more chances to overcome this change in rule issue

Earnings - 40 points

That gives me a 100 points now. If the points system is the same in 2009 as it is now, then I will score the same, and possibly slightly more if my earnings increase. I will still be 27 or under at the time of re-application...

Hari - agreed that a supportive employer is a god-send! Sadly, I don't think that the NHS is all that supportive!

If this the case you no need to worry at all regarding points. Now itself you are having 100 points, even if the rules changes for worser side it is highly unlikly for you to get below 75

Also since your Age point will remain the same even at original time of expiry, you are more safe regarding points

The only thing you should be worried is securing that job till the time of extension if you feel that your job is permenant and secured I think you no need to worry at all

What does this mean? Are they considering / not considering earlier applications?

Whilst an application should normally only be submitted no earlier than five weeks before the expiry of an applicant’s current leave as a Highly Skilled Migrant, any applications submitted earlier than this must, subject to validation, be considered against the appropriate Immigration Rules

I think that means that the vast majority of applications will only be considered within that 5 week window, though any extenuating circumstances will be taken into consideration if an application is submitted earlier.

Basically - no different to what everyone else has said!

I mailed HO asking whether can I apply early for extension if I qualify.

Below was the reply

We recommend that you apply 5 weeks before your existing leave expires, however if you were to submit an application earlier than that, we will consider it.

What I inferred is Once when payment is accepted by home office after initial validation, they have only two options Accept / Reject. They cant return the application.

And as of now as per law they cant refuse based on early application, they can refuse only on the ground of points / english / forgery or other criminal records

Hence no need worry about rejection in early application if we are strong on other grounds

Only thing what we must be prepared is they may issue extension from the date of our application there is more than 90% chances for this. In that case many has to again apply for extension
