HSMP JR ILR PEO Application

Hi,

Thanks very much to everybody giving advice and sharing the experience. I have some questions. I would be grateful if you can reply.

The summary:
My HSMP approved before November 2006, but after April 2006, so I'm in JR 5 year category. My fist HSMP visa started in Feb 2007. I've extended it as Tier1 (General) until 20 February 2012 in Feb 2009.

I am the director in my Ltd Company that all of the shares belongs me. I am working as a contractor consultant. My contracts are with Employment Agencies and my company raises invoices to them. I am getting minimum salary (£7072) + Dividends from the company for the last year. The total payment in the last year transferred from company bank account to my personal bank account is +30K and these are shown both in the company and persona bank statements. Before this year, I was getting only dividends under Secondary Threshold.

I have two dependants applying with me, my wife and my son, over 18, who is a graduate. Both my wife and my son are under employment. I've managed to get an appointment for 14th February.

My questions are:
1. The extended Visa is Valid until 20th Feb 2012, is that mean we are legal on 19th Feb, or on 20th Feb.

2. I can produce personal and company bank accounts, company invoices, company VAT returns, payslips, dividend vouchers for the last 12 months and accountant letter. I think I can't produce P60 since the year end hasn't come yet. Are they enough to support that “I am economically active" which is the condition for HSMP JR ILR application.

3. Under the above conditions, on the form 10G section, do I need to mark the box starting with "If you are employed" or "If you are self-employed".

4. Worst case scenario; is there any chance that the application is refused directly on the application day?

5. If they want me to produce missing documents within a period to complete and submit:
a. Normally, how long is this period?
b. Do I need to submit the missing documents by post or can I submit them personally just to make sure that the submission date satisfy the deadline? In this case, can the submission be done to a different Office from the original application is done?
c. After getting these documents how long does it take to decide? Is there any chance to decide on the same day or next day?
6. Since the time is very critical in our application; let's say the last day in our visa is 20th February and they sent us a refusal letter dated 20th Feb with no right to appeal and we receive this letter on 21st Feb. What happens? Are we become over stayer?
