HSMP refused. Help please for birth certificate issue.

Post by HSMPhelpPlease » Wed Jan 24, 2007 12:44 pm

Got refusal letter today. I was told that I didn't give evidence to support that I do not have a birth certificate. (I also don't drive)

It's ridiculous. Before submitting, I was told by a case worker that there is no need to give such evidence.

What should I put in the review form? Help please.

Hi

If you are claiming points from your age, then you have to submit at evidence of your age such as birth certificate. Otherwise, you dont need to.

Thanks for your reply. I am claiming 20 points for my age.

The thing is I don't have a birth certificate. However they can accept the fact that I don't drive.

Please advise what I should write on the review form.

How can they give you points on age if you cannot justify your real age.

If you cannot provide your Birth Certificate, you have to give reason why you cannot provide such. And depending on ther basis of you reason why you cant provide one will determine if they award you the points or not. Am not quite sure what other forms of evidence you can provide other than your BC. Not having a driving license because you are too young to drive is not valid reason to say that you have no other evidence to prove you age.

Thanks for your prompt reply.

To clear it up, I am old enough to drive, but I don't drive hence I don't have a driving license. I did provide other evidence (notarised copy of the personal details page of my passport with DOB on it). The problem is they didn't consider it because I didn't give evidence for not having a birth certificate.

Apparently it's not easy to get a written proof from my government that they did not issue a birth certificate when I was born (it's a common fact in my country though)

For the sake of review, all I have to do is to convince them that it's a fact that I don't have a birth certificate. How can I do that?

Yes, that is the only thing you need to do but unless you get a proof from your government justifying why you were not given a BC, then other forms of evidence will not matter.

Unfortunately, I cannot think of any other evidence to prove why you dont have a BC apart from the one from your government.

Hi HSMPhelpPlease,

I don't think Home Office is going to change their mind during the HSMP review. What is ur country of residence? In India, you can easily get a driving license made (even if u don't know how to drive), and Home Office accepts it for awarding points for HSMP.
