hi,

i am here about 6 years i have got 3 children born in uk.5 years old and 4 years 2months old. both going to school. my question is can i make humain right application on behalf children. thanks

You will need to give a bit more information about your circumstances before anyone can give you any guidance.

What is your own nationality and immigration status in the UK?

What about the children's other parent?

Have you made any other applications to remain in the UK and if so when? What was the outcome?

Have you been working, claiming benefits, receiving medical treatment while you have been here?

If you are one of the CCOL fraudsters it doesn't look good for you with such young children and using fraudulent documents to stay in the UK. You came as a student, and students are expected to leave the UK at the end of their studies in any case, not claim that their human rights would be breached by doing something they essentially promised to do. Get ready for a refusal and expect to leave the UK.

Have a look at determinations of previous cases. This is a recent case that is case law, read it and you will see if it fits your circumstances.

Hardly surprising that CCOL fraudsters are tempted to put rubbish applications in to UKBA.

Thanks for reply KITTY and PAPER PUSHER

yes i had made an application under human rights, my application was refused dated march 2010 and my lawyer send it back to home ofice for reconsideration but now i am reporting them monthly from last 1 year. My husband had applied for PSW from CCOl and he was refused in 2009. we are over stayed now and have no status, my kids are in full time education and i am not working and not claiming any benefits.

How are you supporting yourselves financially if you're not working or claiming benefits?
What's stopping you from returning home (as you have had to do at the end of your studies anyway if even if they hadn't been fraudulent)? You still haven't said what nationality you all have.
