Husband been refused entry clearance

Hi,

My husband and I have been applying for him to join me and our 9 month old son in the UK for 19 months.

He was in the uk illegally for 7 years and during his stay he was caught by police and at the time he was in a relationship with a polish woman who had told him that her baby was his. When the police caught him in 2005 he told them that his girlfriend was polish and that she had gone to poland to give birth and that she would be returning to the uk with the baby. The police let him go and told him that he had to report to the immigration centre to sign which he only did a few times as the polish woman did not want him to go.

A few months after the polish woman returned to the UK she told him that it was not his baby and wanted to claim benefits. UK government would not give her benefits so she returned to poland.

I met my husband at the begining of 2007, we left UK in October 2008 together to go back to my husbands country. I returned in Dec 08 and then again in Feb 09 when we got married.

As soon as we married we applied for his visa back to the UK as I was 4 months pregnant. His visa was refused due to his relationship with the polish woman, the eco stated that he could not be sure that my husband intended to live with me permently due to his previous relationship.

In July 2009 I gave birth to our son and took him to see my husband for 2 months in Jan 2010.

As the relationship with the polish woman (and she fell pregnant) started before poland joined the eu, so he did not start a relationship with her so he could stay in the UK like the eco suggested, infact she was also illegal in the UK at the time. We have explained this when applying and we had proff that she went back to poland and when (to give birth) as he sent her money monthly. So it is clear that they had met before poland joined the eu but immigartion have not taken that into account.

Basically I would like to know what we can say/do the next time we apply for him to come back to the UK.

Are you British if not what is your immigration status?
