Husband to be was an overstayer - what are our chances?

didnt have much luck with my first post so hope i may get lucky this time!

wonder if anyone can give some advice or info?

i am a UK citizen and my boyfriend is a Malaysian citizen. We initially met here in the UK when he was on a visitor visa. He overstayed for 18 months (lived together for 7 months). He has since returned to Malaysia and I am going to see him in May and we plan to marry then.

ive have read on these sites regarding the dates 1 april or 1 october that the new rules will apply for overstayers but i dont fully understand.

Do i have to wait the 12 months ban before i can apply for him to join me as my spouse or can i apply as soon as we marry?

what are our chances as he was an overstayer?

I appreciate any help or info and thank you for your time in reading this msg.

The new rules were scheduled to come into effect on 1 april, and technically they did. However, they will only be applied if the person is still overstaying on 1 October or longer. So if he is out of the UK now, he should not be affected.

Overstaying will still count against him, so the application can be difficult. But it is not in itself a reason for refusal. If you have doubts, you should ask a lawyer.
