T2 ICT- April 2010 - ILR Eligibility

Hi All,

I would like to know if my case would be considered for ILR. I was initially granted T2 ICT in Nov 2009 but i did not travel on that visa. I had applied for another T2 ICT in March 2010 but dont remember the exact date of which i applied. My second visa has a entry date from 21st April 2010.
Since then I have been in extending the same visa in same category however ICT became ICT Long term staff. Can someone kindly let me know if I am eligible for ILR after April 2015.

Case details:
First visa - Tier 2 ICT, Nov 2009 to Nov 2011 ( didn't travel)
Second visa - Tier 2 ICT, April 21st 2010 to Nov 2011
Extension1 -- followed Nov 2011 - Nov 2013 and
Extension 2 - Nov 2013 to Nov 2015

Please note I was away from UK between December 2011 to June 2012 (200 days) however my visa was valid and i came back on the same visa to UK.

is the stamp in your passport for the second visa T2 Established Staff?

Hi Manci,

Thank you so much for the response. I have provided my details below

1. My CoS was dated March 4th 2010.
2. My visa has a valid entry date from 21st April 2010. Visa Type Tier 2(INT COM Tran) Migrant. I have been extending the same till date. Current visa type - Tier 2 ICT long term staff
3. I believe I attended the visa interview before 6th April 2010, however I couldn't find the exact date of my interview.
4. I travelled to UK on May 10 2010

Kindly let me know If I am eligible for ILR.

From the visa stamp your leave was granted under the rules before 6 April 2010 therefore you will be eligible for ILR in May 2015

Is there a way I can find out the date of application made to UKBA for the very first time.
Also as I mentioned earlier I left UK between December 2011 and returned on June 2012. Though the gap was for 200 days I believe my continuous period of stay if calculated as below can be still considered?

1st Year May 2010 - May 2011 ( no gap just vacation for 15 days).
2nd Year May 2011 - May 2012 ( Gap was Dec 2011 to May 2012 = 157 days)
3rd Year May 2012 - May 2013 (Gap was between May 2012 - June 2012 = 44 days)
4th Year May 2013 - May 2014 ( no gap so far)
5th year - no plans as of now.

Your help is highly appreciated.

the way this works is that you have to make sure that in any of the 12 month periods calculated backwards from the date of the ILR application your absence doesn't exceed 180 days, i.e. your 200 day absence has to be broken up into two periods. It follows that the application must be made between Dec and June.
Also, the absences must be for an acceptable reason. See p19-22
