Also as I mentioned earlier I left UK between December 2011 and returned on June 2012. Though the gap was for 200 days I believe my continuous period of stay if calculated as below can be still considered?
1st Year May 2010 - May 2011 ( no gap just vacation for 15 days).
2nd Year May 2011 - May 2012 ( Gap was Dec 2011 to May 2012 = 157 days)
3rd Year May 2012 - May 2013 (Gap was between May 2012 - June 2012 = 44 days)
4th Year May 2013 - May 2014 ( no gap so far)
5th year - no plans as of now.
the way this works is that you have to make sure that in any of the 12 month periods calculated backwards from the date of the ILR application your absence doesn't exceed 180 days, i.e. your 200 day absence has to be broken up into two periods. It follows that the application must be made between Dec and June.
Also, the absences must be for an acceptable reason. See p19-22
