T2 ICT - ILR eligibility and visa extension

Post by PMO » Mon Jul 13, 2015 5:40 pm

I have query on ILR eligibility and visa extension . My Stays in UK are below.

1. visa Start date – 05/02/2011 (Tier 2 ICT ESTABLISHED STAFF )
2. Visa extend with new COS for same employer till Jan 2016

Please suggest
Q1. Am I eligible for ILR?

Q2. If not , then can I extend my visa in same category which is Tier 2 ICT (For same employer)

Q2. Is it possible to switch in to Tier 2 General from inside UK? if yes, then for how long I can stay on Tier 2 General?

Thanks for your help.

1. No.
2. Yes, as long as your employer is ready to provide you with a CoS.
3. Yes. Max of 6 years. You will be able to apply for ILR after 5 continuous years on T2 General as per current rules.

As long as your employer is willing to extend. After 10 years you would be eligible for 10 years long residence ILR...

But my employer told that there will be a 1 year cooling period after completion of 5 yrs (which will happen on Jan 2016)
Is this rule changed now?

Thanks in advance and this is my last query to this thread.

T2 ICT visas issued between 6-Apr-2010 and 05-Apr-2011 are not subject to a limit of 5 years. Read the T2 guidance in detail. You'll find all the information there.

Cool-off will only be applicable if you go back to your home country and then want to apply for a new visa from there.
