Hi Gurus,
Can you please provide your valuable advice to my below query.

I came to UK on 22 NOV 2009 and was here till 30 DEC 2012.

I went back to India on 30 DEC 2012 and came back to UK after 15 months on 26 March 2014 with the same VISA which got renewed from UK on APRIL 2012.

Please note that am on Tier 2 ICT VISA with the same company through out the whole period till now and worked in the same company back in India also.

I have renewed my VISA in April 2014 in UK and got the VISA till FEB 2015 and went for a renewal in FEB 2015 and got the VISA till FEB 2017.

In the mean time, i tried applying for ILR in May 2015 and it got rejected saying that i had more than 180 days of gap in the year 2013. I have applied based on the compassionate reason as i had some complication in my wife's pregnancy. In the rejection letter, HO has accepted my compassionate reason but they suggested that it is a long gap and so they can't accept it as a compassionate reason.

My query here is whether i can be eligible for ILR in Nov 2018 as my ILR counter has reset(i.e., Re-entry in March 2016 + 5 years - 6 months) .
One more query is that if am switching to Tier 2 General in the mean time before Nov 2018, whether my counter will restart again for applying ILR or my Tier 2 ICT stay will be counted?

Please kindly provide your valuable advise.

1. Should be okay to apply for settlement in Oct./Nov. 2018.
2. No, ILR clock will not be reset.

One more query, whether the salary eligibility of 35,000K which is applicable from April 2016 is applicable in my case?

Yes, if you apply for settlement as a Tier 2 General migrant.

Also am hearing that there may be a chance that HO will increase the salary threshold of tier2 ict from 41k and if that's the case , will it be applicable for the tier2 ict issued before 2010 April?
