Hi, currently I am in a work permit which is ending soon, My company is willing to extend it in new PBS system under Tier2. I am sure that i could get the necessay points, but i want to make sure everything perfect.

My question is, Is it necessary to show them them in paper that my level of language skill to earn 10 points. Also I read in BIA website that the employees who's already in the UK will automatically gain 10 points.

will someone please verify this and let me know whether I must sit for the exam to gain the points?

Hi,

Was your work permit issued for the maximum period? If so you can't extend it, therefore you are required to apply for a new one. However, this will need to be done under the Tier 2 of the PBS.

As it will be a new application you will need to show your English ability. People on WP's issued for less than the maximum period can extend them - under the new Tier 2 system - up to the maximum period of 2 years. This should be done before the T2 launch date. In this case you would be transferring from WP to T2 and therefore wouldn't need to prove English language ability.

Oh and if you are on a multiple entry WP then you can not use the transitional arrangements as above. You will need to leave the UK and apply under the category available to you at that time. You will need to meet all the requirements.

I can't find anything that says you will not need to show English ability under the Tier 2. I think you will as you will have to apply for it from scratch as you can't use the transitional arrangements. That is if your WP was issued for maximum period initially.

Under T2 your employer will need to be registered with the UKBA in order to issue with a sponsorship certificate. So, hopefully they have registered.

If you WP expires before T2 launch then you can apply under existing WP rules or leave the UK and apply under T2 when it is launched.

I mean maximum 5 years. Then you have ILR or can apply all over. Now I have seen the bit you mentioned. So yes it seems you will not need to show English ability unless your WP is multiple entry.

Thanking again for your valuable points, I've been here in UK for 3.5 years, need another 18 months to get the ILR. My compnay is preparing to get the Sponsorship certificate. Thank you very much.
