On ILR, 5yrs as Tier 2 ICT, Spouse Dependent Extension Now?

Post by Sivanesan » Wed Aug 19, 2015 4:21 pm

Hello,

Please can someone point me to the right direction? Basically, which visa category should I go for my wife's extension?

1. I have got ILR this year (Jan 2015), moved to a new job
2. Previously spent 5 years under Tier-2 ICT (single employer)
3. Wife got Tier-2 Dependent Visa until Dec 2015 when I was in Tier-2 ICT (first time dependent visa, came to the country Oct 2013, about to complete 2 years, currently working as well)

Now, for my wife's extension which visa should I go for? is it PBS?

I spoke to a third party agent based out of London, just to get their opinion, they mentioned that '''she is illegally staying here (from Jan 2015) as my Tier-2 ICT is no more valid so is her dependent visa''' which I feel it is wrong...

Please let me know your inputs.

Many thanks.

Thanks for your quick response! Is there any maintenance funds requirement in this category as part of the extension?

Dear Moderator,

After reading several posts, I could see that PBS Dependent Extension is the right thing to do as FLR (M) will reset her clock.

Just couple of queries, it would be great if you can answer:
1. PBS Dependent Guidance, bullet-in 60: My wife is going to apply for this extension separately (as I have already got ILR), do I still need to maintain £945 + £630 for 90 consecutive days or just £630 for 90days in my bank account.
2. Is this the right application form for PBS Dependent Extension: Application for a Grant of Leave and Biometric Immigration Document as a Tier 1, 2 o r 5 Dependant?
3. If above form is right, which category should I fall under (Note: I have got ILR via 5 years staying as Tier 2 - ICT):
a.Tier 2 General, ICT Long Term Staff, Sport & MOR - up to 3 years leave to remain - £651
b. Tier 2 ICT Short Term Staff, Graduate Trainee or Skills Transfer - £445
c. Tier 2 General, ICT Long Term Staff – over 3 years leave to remain - £1,302
d. Tier 2 Shortage Occupations - up to 3 years - £428
e. Tier 2 Shortage Occupations - over 3 years - £856

Many thanks.

1. £630
2. Yes.
3. Choose the one that you were under at the time of your settlement application.

Many thanks for your quick response, I really appreciate it.

Can we apply for extension before 28 days of visa expiry or should we need to wait?

Seniors, is it sill the same?

I heard that there were some changes on Nov 2015? Can I still go ahead and apply as a PBS dependent for my wife?
