ILR and FLR(M) help needed

hi board members and admin

this is a fantastic place for advice cant believe its so good ..

i have a question plz would appreciate if someone can answer it

My Ilr on 10 years base is due now and i have my wife here with me on a PBS dependant visa as I am on PSW at the moment. Her visa runs out in september 2014,

My question is

Is it compulsory for me to apply my ILR an her FLR(M) at the same time or can I apply at a later date before her dependant visa expires.. please let me know as I am in a mess at this point

It's best to do it at the same time as the rules could change any time.

I cant at this time , she has to go through english test which is a bit hard for her so I wanna apply later for her , I just wNt to know that

1. will her stay become unlawful if i dont apply for her with my application?

2. I f i apply later but my passport is still in home office can I just send her application with my details as sponsor on it or I have to wait for the outcome of my decision,?

I am only having to do this as my brother's wedding is in october and I cant risk my passport stuck there in that time.

Hi,
Her Stay will remain LEGAL until the date when her Visa is Expiring, has nothing to do with your ILR and change of Visa Status. UKBA has clearly written on website that When should you apply?
You must be in the UK when you make your application, and you must apply before your current permission to stay expires. We encourage you to apply 28 days before the expiry date, but you can choose to apply earlier than this.
