ILR and Old UKBA rules Pre July 2012

Hello Everyone

Got a question about ILR

My partner came for into the UK on a Fiancée visa pre the July 9th 2012 changes.

Marriage: July 14 2012
Application: End of July

Outcome: application rejected on insufficient funds in sponsor account

Appeal: won after supported account statements were delivered

Result: UKBA gives My partner 2.5years after along period on new rules ( we started the process under old rules)

Stage 2: 2:5 years renewal he was then given discretionary leave dues to not satisfying 12 months of income. Both states new jobs.

Problem: partner now on a 10 year route and it has been brought to my attention that he should not have been under this new rule in the first place.

Now we want to apply for ILR

A fiancée visa was granted in 2012

Current route means ILR won’t be given till 2026

Please advise if you have any suggestions or advice for such a case.
