My ILR and my son's MN1 - Gap in status

Post by helpneeded2011 » Mon May 23, 2011 5:11 pm

I am currently on Tier 1 visa and my son is a Tier 1 dependent on me until Apr, 2012. He was born in the UK last year. I am going for my ILR next week and planning to skip his ILR and apply directly for his citizenship registration via MN1 form. How soon should i apply for his MN1 after i get my ILR? His current Tier 1 depenedent visa is valid until Apr, 2012. I am planning to apply for his BC after a month or so since I am in the process of moving home and don't want any address change after I send out the MN1 form. Would this gap between my ILR approval and his MN1 form be a problem? He is not planning to travel out of the UK. What would be his status during this gap ?

Please help.

Candid opinion on these matters are, apply for ILR for all dependants as you are applying for yours because there could be an eventuality that could neccesitate travel, however you can apply for MN1 only after you have been granted settlment so in essence any time after that is fine.

If he was born in the UK and he's not traveling, then it should be okay for him to wait and directly apply for MN1 when ready.
