ILR and working abroad in recession period

Post by soulfullness » Sat Mar 13, 2010 9:44 am

Hi all

I would like to clarify from you that working abroad for less than 2 years after getting ILR. I got my ILR last january 2010 and there is few conditions of going out of UK with ILR approval by home office.

The conditions says what happens if you leave the UK after ILR:

1) You will be not re-admitted as a returning resident if you are resident overseas and only return here for a short period.

What this means? As i want to take a job overseas as there is no job prospect at the moment for me in UK and I intend to go soon abroad for less than 2 years and within these 2 years I may return and go back and come again. The problem is when I come after one year or shorter period (see 1 above condition) , immigration control may ask whether I return for settlement but I have to go again and then come befor 2 years expire. Is this a problem. Please clarify if you know of it. I did telephone an officer in UK border agency she told me there is no problem as long as it is less tan 2 years but she does not want to give in writting and also she said I can come and go within this 2 years as long as 2 years are not exceeded.

I hope to keep my famaly during this period in UK to show that there is strong connection with UK. Is this OK as in case of staying over 2 years , it says that you have to have strong connection with UK to re-enter.

Please give me early response

Kind regards
