ILR application - Bachelor qualification question.

Dear All,

I am applying for settlement and is confused about a little note in the application.
* you can only claim points for a Bachelor’s degree level qualification if you have previously been granted
leave to enter or remain as a Tier 1 (General) Migrant, Writer, Composer or Artist or a Self-Employed
Lawyer; and that leave was granted under the rules in place before 31 March 2009.
This is in SET(O) Application form (Version 05/2011) - Page 19

My entry clearance was as a student few years ago, then following work permit, and HSMP, my first tier 1 general application was in June 2009.

Since the Bachelors qualification was accepted in this tier 1 general (extension) as well as hsmp application in 2007, I wasn't expecting this would become an issue?

If you have been granted ILR under similar conditions or an expert in this, could you please advice.

You should take the date when HSMP was granted to you and NOT T1G.

Qualifications: notes
13. An applicant will be awarded no points for a Bachelor's degree if:
(a) his last grant of entry clearance was as a Tier 1 (General) Migrant under the rules in place between 31 March 2009 and 5 April 2010, or
(b) (i) he has had leave to remain as a Tier 1 (General) Migrant under the rules in place between 31 March 2009 and 5 April 2010, and
(ii) his previous entry clearance, leave to enter or leave to remain before that leave was not as a Highly skilled Migrant, as a Writer, Composer or artist, as a self-employed lawyer, or as a Tier 1 (General) Migrant.
